
Can Samsung catch a break? No, at least not in Europe. If you’ve been following the ongoing courtroom battle between Apple and Samsung, you’ll know that Apple has won some key victories, namely getting both the Galaxy Tab tablets and Galaxy S/S II phones banned in some form or another.
While the injunction against Samsung’s phones still has a couple weeks before the actual sales ban starts, the Galaxy Tab tablets have already been affected by the original preliminary injunction. And today it gets worse…
A Dusseldorf court upheld the earlier preliminary injunction against Samsung and their Galaxy-branded tablets. While the judge has gone ahead and stated that Apple’s argument(s) aren’t necessarily right, Samsung did not make a strong enough case to overturn the initial ban. The presiding judge set a new court date for a post-hearing ruling on September 9th. Until that date, Germany will continue operating Galaxy Tab free.
In regards to evidence that Apple was tampering with Galaxy Tab and Galaxy S renderings — the court disagreed with Samsung’s assertions that Apple was doing so to alter the court’s decision/better their own case.
Looks like Samsung’s ongoing Apple problems continue to deepen…
