Judge Denies Preliminary Ban On Galaxy Tab In U.S. (But Voices Support For Apple “In The Long Run”.)

Samsung could be in for an upset loss in the states if comments from presiding judge Lucy Koh are any indication of the final outcome. Today Koh stated that based on the evidence she’s seen so far, a preliminary injunction barring sales doesn’t make sense when based off of a “utility patent”. However, things turned more serious when Koh mentioned that while she doesn’t necessarily know how/if Apple will prove the validity of the claims/patents she believes that Samsungs Galaxy Tablets in particular do infringe on the iPad.

Probably personal opinions aside, the really telling moment came when Koh held both an iPad and Galaxy Tab over her head and asked Samsung’s attorneys to pick out the Galaxy Tab. While they did pick the right device, a witness present at the preliminary hearing, Dan Levine, mentioned that it took them quite a while.

At this point in the game (and after a loss in Australia) Samsung needs all the good news they can get. Hearing the judge of an upcoming trial say that she’d “likely side with Apple in the long term” isn’t likely to boost the morale of Samsung’s legal team.

Samsung Could Abandon Australian Galaxy Tab Launch Plans.

A new report by Bloomberg lays a bleak future for Australian Galaxy Tab hopefuls — The company’s planned launch of the 10.1″ device will essentially be abandoned in the country if Samsung can’t win a reverse ruling of some sort within the next couple of weeks.

The news is depressing, though not surprising. The Galaxy Tab has already been delayed from entering the Australian market for a solid two months. With the holiday season quickly approaching, entering the market much later will essentially destroy any chance the Galaxy Tab had. Not to mention, the next-gen dual- and quad-core hardware should start popping up.

With an Australian launch appearing down for the count, we’re left to hope the other major lawsuits in Japan, Korea, and The Netherlands reach a more formidable solution, and sooner rather than later.

Samsung Permanently Barred From Selling 10-Inch Galaxy Tab In Germany.

It’s been a long, laborious road for Samsung overseas in Europe and The Netherlands thanks to a slew of lawsuits filed by Apple against Samsung’s Galaxy Tab Android tablets. Today it gets worse — much worse. The judge overseeing the Apple vs. Samsung lawsuit in Germany’s Dusseldorf court just issued a permanent ban on the 10″ Galaxy Tab. What it means is that stores will no longer be able to sell the 10″ tablet nor will Samsung Germany be able to sell it outside of Germany.

Samsung has already responded to the ruling, citing their (obvious) disappointment, and vowing to vigorously defend their own intellectual property as well as pursuing Apple’s violations of Samsung’s patents and IP.

Meanwhile yesterday Apple continued their attacks on Samsung’s Galaxy S products with new lawsuits filed in Japan also seeking to stop the sale of Saumsung’s most popular line of smartphones and tablets this year.

Keep the popcorn hand as we have a feeling this battle between two giants is far from over…

Samsung’s Galaxy Tab Australian Re-Launch Delayed Until September 30th.

After a previous injunction ruling was issued that would have eventually allowed Samsung’s Galaxy Tab to resume sales in Australia come September 12th comes a second delay compliments of judge Annabelle Bennett. Bennet stated that “it only made sense to wait until a hearing due in the last week of September that would determine whether a preliminary injunction would be upheld”. Result: No Australian Galaxy Tabs until September 30th at the earliest.

Hopefully Samsung’s Galaxy S II and Galaxy Tab follow-ups are unique and powerful, because at this rate the Galaxy S II and Tab hardware is going to be caught up in courtrooms for weeks to months — essentially missing out on the current generation of hardware.

Samsung Set to Announce Galaxy SII And 8.9″ Galaxy Tab With LTE.

Samsung’s Galaxy S II smartphone has dominated the Android landscape across the pond in Europe. While we here in the states are finally this close to getting our own taste of Samsung’s latest and greatest, the company is set to one-up themselves this coming week at Berlin’s IFA conference. There, Samsung will officially unveil slightly tweaked Galaxy S II phones and an 8.9″ Galaxy Tab with one very important feature — LTE.

But there’s more. Besides the faster wireless goodness, Sammy has managed to bring a faster 1.5 GHz dual-core processor to both devices. Finally, the Galaxy S II in particular will also get a screen upgrade to 4.5″ (AMOLED).

Pricing and release are still up in the air. Also unknown: How Sammy and Apple’s currently waging patent war overseas will affect the new devices there as well as here in the states.

10.1″ Samsung Galaxy Tab TouchWiz Update Halted “To Assess Progress”.

Still waiting for your official TouchWiz update for your 10.1″ Samsung Galaxy Tab? You may be waiting a bit longer if several tweets fired off by @SamsungCarla are accurate. According to Carla, Samsung is holding off on further updates to “assess progress and ensure it’s a positive experience for customers”. Whether or not that statement is in fact literal or Samsung simply found some bugs remains to be seen. Unfortunately neither Carla or Samsung will clarify further.

Any 10.1″ Galaxy Tab owners who already received the update are invited to share with us any and all bugs that may have been brought on by the latest update.

[Update] Samsung Lucks Out In Netherlands. Injunction Ruling Over Galaxy Tab 10.1 Delayed Until September 15th.

The EU-wide ban on Samsung’s latest 10.1″ Galaxy Tab tablet originally exempted The Netherlands. And luckily for Samsung it will stay that way for a few more weeks. A Netherland judge has ruled that any decision on a ban within the country will have to wait until September 15th at the earliest. (Apple had been trying to rush through a judgment/injunction.)

According to FOSS Patent’s Florian Mueller, the particular patent infringement claims made by Apple in the Dutch court are more vague than the EU counterparts and even delve deeper into the software side of things instead of just hardware design as do the EU claims.

The fight continues…


The EU-wide ban has been suspended for the time being pending a new ruling on August 25th.

In the current tablet market, the iPad 2 is still the undisputed king. Some participants such as the Motorola XOOM and older, smaller Samsung Galaxy Tab have certainly put up a fight thus far, but ultimately failed to claim any serious market share. Back for round two, however, is Samsung’s larger, more threatening 10.1″ Galaxy Tab.
